RVAltCtrl Terms of Service

These Terms of Service ("Terms") govern your purchase, installation, access to, and use of RVAltCtrl hardware, firmware, software, websites, cloud services, remote-access services, subscription features, and related services (collectively, the "Services").

RVAltCtrl is provided by RVAltCtrl.com ("RVAltCtrl," "we," "us," or "our").

By purchasing, installing, accessing, or using RVAltCtrl, you agree to these Terms. If you do not agree to these Terms, do not install or use RVAltCtrl.

1. About RVAltCtrl

RVAltCtrl is an owner-installed monitoring and control system designed for compatible recreational vehicles ("RVs"). Depending on the RV, configuration, and enabled features, RVAltCtrl may monitor information from the RV's electronic systems and may transmit commands to compatible equipment.

RVAltCtrl primarily operates locally through a web interface served directly by the RVAltCtrl device on the owner's private network. Certain optional features, including remote access, remote support, subscriptions, and other cloud-enabled functionality, may communicate with RVAltCtrl cloud services.

RVAltCtrl is an independent product and is not part of, endorsed by, or warranted by the manufacturers of the RV or third-party equipment with which it may communicate unless expressly stated otherwise.

2. Installation and Compatibility

RVAltCtrl is intended to be installed by the owner in accordance with the instructions provided for the product.

You are responsible for:

  • determining that RVAltCtrl is appropriate for your RV and configuration;
  • following all installation instructions;
  • making appropriate electrical, network, and communication-bus connections;
  • ensuring that installation does not interfere with the safe operation of the RV or its equipment; and
  • discontinuing use and disconnecting RVAltCtrl if you observe abnormal or unexpected behavior that may be related to the device.

RVs may contain equipment, controllers, firmware, modifications, accessories, or third-party devices that RVAltCtrl has not tested. Compatibility with every RV, component, firmware version, configuration, or modification cannot be guaranteed.

3. Communication With RV Systems

RVAltCtrl is primarily a monitoring system but may also transmit commands over supported RV communication networks, including CAN-based networks such as RV-C, CZone, or other compatible systems.

Although RVAltCtrl is designed and tested to communicate using appropriate commands and protocols, communication with third-party electronic systems involves inherent compatibility and operational risks.

RVAltCtrl does not warrant that every connected controller, device, firmware version, or RV configuration will respond to commands exactly as expected.

You assume responsibility for using RVAltCtrl with your particular RV and connected equipment.

4. Physical Equipment and Safe Operation

RVAltCtrl can operate physical equipment. You are responsible for ensuring that operation is safe before issuing or authorizing any command.

Depending on your RV and configuration, RVAltCtrl may control equipment such as awnings, fans, pumps, lighting, climate equipment, or other connected systems.

Before operating physical equipment, you are responsible for determining that the equipment can be operated safely and that the surrounding area is clear of people, animals, vehicles, structures, trees, objects, weather hazards, and other conditions that could cause injury or property damage.

This responsibility applies whether equipment is operated:

  • from the RVAltCtrl local interface;
  • through remote access;
  • through a wireless button, sensor, or accessory;
  • through an automation, routine, or trigger;
  • through an external integration or service; or
  • by any other method supported by RVAltCtrl.

In particular, you must visually verify that an awning and its surrounding area are clear and that conditions are appropriate before extending, retracting, tilting, or otherwise operating the awning.

RVAltCtrl does not independently determine whether the physical surroundings are safe before executing a command. The fact that RVAltCtrl permits or accepts a command does not mean that operation of the connected equipment is safe.

To the maximum extent permitted by applicable law, RVAltCtrl is not responsible for injury, property damage, equipment damage, or other loss resulting from unsafe operation, failure to inspect the surrounding area, improper installation, user-configured automations, or misuse of connected equipment.

5. Automations, Routines, Triggers, and External Integrations

RVAltCtrl may allow you to create routines, automations, schedules, triggers, wireless sensor actions, button actions, and integrations with third-party systems.

You are responsible for the automations and triggers you create and for considering the consequences of their execution, including execution when you are not physically near the RV.

An automation or trigger may execute because of sensor readings, time, equipment status, button presses, network messages, or other conditions. Sensors and communication systems can also produce unexpected, delayed, missed, or inaccurate information.

Do not configure an automation that could create an unsafe condition if it operates unexpectedly, operates at the wrong time, or operates without someone present to verify that the surrounding area is safe.

RVAltCtrl does not guarantee that an automation, trigger, routine, notification, or command will execute, execute only once, execute at a particular time, or successfully reach the intended equipment.

6. Monitoring, Alerts, and Safety-Critical Uses

RVAltCtrl may provide monitoring, notifications, security-related features, temperature information, equipment status, sensor information, and alerts.

RVAltCtrl is not a life-safety, security, medical, emergency-response, fire-protection, animal-safety, or other safety-critical system.

Do not rely exclusively on RVAltCtrl to protect people, animals, pets, property, or equipment.

For example, a temperature alert should not be used as the sole means of protecting an animal left in an RV. Notifications and monitoring can fail because of Internet outages, Wi-Fi failures, power loss, Bluetooth interference, sensor failure, cloud-service interruption, software problems, configuration errors, mobile-device settings, or other circumstances.

You are responsible for maintaining appropriate independent safety measures for any situation in which failure of RVAltCtrl could result in injury, death, property damage, or other significant loss.

7. Internet and Network Availability

Some RVAltCtrl functionality operates entirely on the local network, while other features require Internet access or third-party services.

Remote access, notifications, subscription management, cloud status, and other features may be unavailable because of Internet outages, cellular or satellite service interruptions, Wi-Fi problems, server maintenance, power loss, third-party service failures, or circumstances outside RVAltCtrl's control.

RVAltCtrl does not guarantee continuous or uninterrupted availability of local, remote, cloud, notification, or third-party services.

8. Device Identifiers

Each RVAltCtrl device is assigned a unique device identifier used to locate limited device information through RVAltCtrl cloud services.

The device identifier is not intended to function as a remote-access credential. Possession of a device identifier alone does not authorize remote control of the RV.

However, a person who obtains a valid device identifier may be able to view the limited device status made available through the cloud service. You should therefore avoid unnecessarily publishing or sharing your device identifier.

RVAltCtrl uses technical safeguards, including rate limiting, to help prevent automated attempts to discover device identifiers.

9. Remote Access

Remote access is an optional feature that requires authorization from the device owner.

Remote-access credentials are generated by the owner through the RVAltCtrl device. RVAltCtrl's cloud service does not store the owner's normal remote-access credential.

You may choose to save a remote-access credential in your own browser for convenience. If you do so, the credential is stored in that browser's local data. You are responsible for protecting devices and browsers in which you choose to save credentials.

Do not save remote-access credentials on public, shared, or otherwise untrusted computers or devices.

RVAltCtrl provides controls that allow you to remove a locally saved remote-access credential from the browser.

You are responsible for protecting remote-access credentials and for access performed using credentials you have generated or shared.

10. Remote Support

RVAltCtrl support personnel do not have automatic or persistent access to your RVAltCtrl device.

If you request remote support, you may explicitly create and provide RVAltCtrl with a temporary support credential. Support credentials can only be created through the device's local interface.

When creating a support credential, you select an authorization period of 7, 30, or 90 days.

While the credential remains valid, authorized RVAltCtrl support personnel may manually initiate a connection to the device and may have access to information and controls available through the remote interface.

Support personnel do not automatically connect to your device in the background.

You may revoke a support credential at any time through the device's local interface. Revocation causes the device to reject future attempts to use that credential.

Support credentials stored by RVAltCtrl are automatically deleted after their expiration date. A revoked credential may remain stored until it is manually removed or reaches its expiration date, but the device will no longer accept it after revocation.

You should only create a support credential when you want RVAltCtrl support personnel to have temporary access to your device.

11. Subscriptions, Passes, and Paid Features

Certain RVAltCtrl features may require a subscription, membership, pass, license, or other purchase.

Prices, durations, included features, and applicable taxes will be disclosed at the time of purchase.

Subscriptions automatically renew according to the billing period shown when you subscribe unless canceled before the next renewal.

Subscription billing and management may be provided through Stripe or another disclosed payment processor. You may be redirected to the payment processor to enter payment information or manage your subscription.

You are responsible for canceling an automatically renewing subscription if you do not want it to renew.

We may change prices or available subscription plans in the future. Any changes affecting an existing automatically renewing subscription will be handled in accordance with applicable law and any notice requirements.

12. Refunds

Refund eligibility for hardware, subscriptions, passes, licenses, and other purchases is subject to the refund or return policy presented at the time of purchase and applicable law.

RVAltCtrl may, at its discretion, provide refunds or other accommodations in circumstances where we determine they are appropriate.

Nothing in these Terms limits any refund, return, or other consumer right that cannot legally be waived.

13. Software and Firmware Updates

RVAltCtrl may provide firmware, software, configuration, compatibility, or security updates.

Updates may modify features, correct problems, improve security, add support for equipment, remove obsolete functionality, or change how existing functionality operates.

You are responsible for maintaining your device in a reasonably current and supported configuration when an update is necessary for security, compatibility, or continued service operation.

We do not guarantee that every feature or integration will remain available indefinitely.

14. Third-Party Products and Services

RVAltCtrl may communicate with or integrate with third-party hardware, software, networks, sensors, services, or platforms.

Third-party products and services are governed by their own terms, privacy policies, warranties, and availability.

RVAltCtrl is not responsible for the operation, availability, security, accuracy, compatibility, or continued support of third-party products or services.

15. Acceptable Use

You may not use RVAltCtrl or its Services to:

  • gain unauthorized access to another person's RVAltCtrl device or systems;
  • attempt to discover or obtain another user's credentials or device information without authorization;
  • interfere with, overload, probe, attack, or disrupt RVAltCtrl infrastructure;
  • bypass security, authentication, rate limits, licensing, or access controls;
  • use the Services for unlawful purposes; or
  • knowingly use RVAltCtrl in a manner that creates an unreasonable risk of injury or property damage.

We may restrict or terminate cloud access associated with abuse, attacks, fraud, security threats, or unlawful use.

16. Intellectual Property

RVAltCtrl hardware designs, firmware, software, interfaces, documentation, graphics, trademarks, and other materials may be protected by copyright, trademark, patent, trade-secret, or other intellectual-property laws.

Purchasing RVAltCtrl does not transfer ownership of RVAltCtrl software, firmware, trademarks, or other intellectual property except for the limited rights necessary to use the product as intended.

Any open-source software incorporated into RVAltCtrl remains subject to its applicable open-source license.

17. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EXCEPT FOR ANY EXPRESS WRITTEN WARRANTY PROVIDED WITH THE PRODUCT, RVAltCtrl AND THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

WE DISCLAIM IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, COMPATIBILITY, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE, TO THE EXTENT SUCH WARRANTIES MAY LEGALLY BE DISCLAIMED.

WE DO NOT WARRANT THAT RVAltCtrl WILL BE COMPATIBLE WITH EVERY RV OR COMPONENT, THAT OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE, THAT EVERY COMMAND WILL BE DELIVERED OR EXECUTED, THAT EVERY ALERT WILL BE RECEIVED, OR THAT RVAltCtrl WILL PREVENT DAMAGE, LOSS, INJURY, THEFT, EQUIPMENT FAILURE, OR OTHER EVENTS.

Some jurisdictions do not permit certain warranty exclusions, so some of these exclusions may not apply to you.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RVAltCtrl AND ITS OWNERS, AFFILIATES, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO RVAltCtrl OR THE SERVICES.

THIS INCLUDES, TO THE EXTENT PERMITTED BY LAW, LOSS OF USE OF AN RV OR EQUIPMENT, LOSS OF DATA, LOST PROFITS, TRAVEL INTERRUPTION, TOWING OR REPAIR COSTS, SUBSTITUTE TRANSPORTATION OR LODGING, MISSED OR DELAYED NOTIFICATIONS, NETWORK OR COMMUNICATION FAILURES, THIRD-PARTY EQUIPMENT MALFUNCTIONS, OR DAMAGE RESULTING FROM AUTOMATIONS, REMOTE COMMANDS, INSTALLATION, OR OPERATION OF CONNECTED EQUIPMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RVAltCtrl'S AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE PRODUCT OR SERVICES WILL NOT EXCEED $500.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

19. User Responsibility and Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses, or expenses resulting from your unlawful use, misuse, unsafe operation, unauthorized modification, improper installation, or violation of these Terms.

20. Transfer or Sale of a Device

If you sell, transfer, or otherwise give an RVAltCtrl device to another person, you are responsible for removing locally stored credentials, revoking active remote-access or support credentials where applicable, and taking reasonable steps to remove personal or configuration information you do not want transferred.

The new owner may be required to perform a device ownership or setup process before using cloud or paid features.

21. Changes to the Services

RVAltCtrl may modify, improve, replace, discontinue, or restrict features or Services as the product evolves.

Where required by law, we will provide appropriate notice of material changes affecting paid services or existing subscriptions.

22. Changes to These Terms

We may update these Terms from time to time to reflect changes to RVAltCtrl, our business practices, or applicable law.

The current version will be made available on the RVAltCtrl website with its effective date.

Continued use after an updated version becomes effective constitutes acceptance where permitted by applicable law. Where affirmative consent is legally required, we will request it.

23. United States Availability

RVAltCtrl is currently offered for sale and supported in the United States.

We do not represent that the product or Services are appropriate for use or comply with laws outside the United States.

24. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or relating to RVAltCtrl, its products, or the Services will be governed by the laws of the State of Florida, without regard to its conflict-of-law principles.

Except for disputes that qualify for small claims court or claims for which arbitration cannot legally be required, any dispute, claim, or controversy arising out of or relating to these Terms, RVAltCtrl, its products, or the Services will be resolved through binding individual arbitration rather than in court.

Arbitration will be conducted on an individual basis. You and RVAltCtrl waive the right to a trial by jury and, to the extent permitted by applicable law, the right to participate in a class action, class arbitration, or other representative proceeding.

The arbitration will take place in Florida, unless applicable law requires another location or the parties agree to another location or remote proceeding.

Nothing in this section prevents either party from bringing an eligible individual claim in small claims court or seeking temporary or emergency injunctive relief where permitted by law.

25. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
